It may not be known until February whether charges will be filed against Charlie Sheen for alleged domestic abuse.
Prosecutors tell ET that they probably won't decide if they will file charges against him until just prior to his next scheduled court appearance on Feb. 8.
The actor was arrested Christmas Day on suspicion of menacing, second-degree assault and criminal mischief. Chief Deputy District Attorney Arnold Mordkin said on Monday that second-degree assault is the most serious charge and usually carries potential jail time of two to eight years, with a fine of $2,000 to $500,000.

Following a dramatic five-year custody battle, David Goldman reunited with his son Sean in Brazil on Christmas Eve and tells the "Today" show that he and his son will "heal."
When Sean was four, David's then-wife took their son on a two-week trip to Brazil but never returned. David's wife then divorced him and married a prominent lawyer. She passed away last year and her Brazilian husband then tried to adopt Sean, but Brazilian courts eventually ruled that Sean must be returned to Goldman, his father. Cameras captured a mob scene on Thursday, Dec. 24, as Sean, 9, was led by his stepfather to the U.S. consulate in Rio de Janeiro to be reunited with his father.

Hailey Glassman's attorney defends his client in a statement to ET, following the news that Glassman's ex-boyfriend Jon Gosselin returned home to his Manhattan apartment on Saturday afternoon only to find it "wrecked."
Gosselin's former attorney, Mark Jay Heller, Esq., told ET that the reality star "was horrified, disheartened, and saddened to observe the devastation of his furniture, clothing and personal belongings, which were apparently slashed with a butcher knife by a very troubled and sick perpetrator." Heller also claims that "Jon's television, CD player, coffee maker, a Nintendo Wii game, dishes, pots and pans were burglarized from his apartment."
Glassman's attorney Anand Ahuja responds to the incident, telling ET, "To me, it appears to be a huge publicity stunt. Ivana Trump was escorted off a New York-bound airplane on Sunday after police say she became angry with some children on the flight.
Trump was scheduled to return to New York from Florida but was instead taken off the aircraft for allegedly cursing at some kids that were running and screaming down the aisles, police tell ET.
Law officials claim that when the flight attendants attempted to calm the first ex-wife of Donald Trump, she became even more agitated. Palm Beach County sheriff's deputies say they asked Trump to exit the plane but she refused. It was then that she was escorted off the aircraft.

ET has learned that Jon Gosselin came home to his Manhattan apartment Saturday afternoon to find it "wrecked," according to his attorney, with a note "that had been affixed to Jon’s bedroom dresser by a butcher knife."
The former "Jon & Kate Plus 8" reality star's attorney, Mark Jay Heller, Esq., claims that Jon "was horrified, disheartened, and saddened to observe the devastation of his furniture, clothing and personal belongings, which were apparently slashed with a butcher knife by a very troubled and sick perpetrator."

ET has learned that an undisclosed "weapon of some sort" was involved in Charlie Sheen's domestic violence incident that happened Christmas Day in Aspen, CO. Aspen Police Department spokesperson Stephanie Dasaro would not reveal what kind of weapon was involved, but she did confirm to ET that the charges against the "Two and a Half Men" star do involve the use of "a weapon of some sort." The 44-year-old star was arrested and put in jail yesterday morning after police responded to a 911 call. He is charged with second degree assault, a class four felony; menacing, a class five felony; and criminal mischief, a class one misdemeanor. After spending a good portion of his Christmas Day in an Aspen, CO, jail on domestic violence charges, ET can confirm that Charlie Sheen is no longer behind bars. Read on for details... According to the Pitken County Sheriff's Office, just before 7 p.m. local time Judge James Boyd informed Sheen that he would be released from jail and must return to Aspen on February 8, 2010 to face the judge in court. Sheen posted an $8,500 bond. At approximately 8:30 in the morning, officers responded to a 911 call at 320 West Hallam Street and arrested the "Two and a Half Men" star for second degree assault, a class four felony; menacing, a class five felony; and criminal mischief, a class one misdemeanor.
